The health policy known as Title 42 expires at 10:59 p.m. Central time Thursday, barring a last-minute legal challenge.

As the flow of migrants traveling to the southern border increases, Biden’s administration finalized a new rule Wednesday morning that will begin denying asylum to migrants. Under the new measure, migrants who show up at the border without first applying online or without seeking protection in a country they traveled through will be barred from claiming asylum. Migrants who unlawfully enter the U.S. and are removed, will be unable to reenter the country for at least five years, according to U.S.

Authorities reported encounters of more than 10,000 migrants along the southern border Tuesday, continuing an upward trend in border arrests. About 155,000 migrants are waiting in northern Mexican border states, many with the goal of crossing into the U.S. to seek political asylum, according to the Mexican government. Are there plans to increase the number of personnel at the border?

The rule reshaping the asylum process in the U.S. has been met with swift criticism. Director of Border Strategies at the ACLU Jonathan Blazer said Biden’s new measure is ushering in a new wave of suffering for people already enduring violence and persecution. The group’s lawyers have said that they and their partners plan to challenge the rule.
