NEW: An Adams County judge this week dismissed first-degree murder charges against the parents of a toddler who died of fentanyl poisoning earlier this year, court records show.
Quick found that there was no evidence the parents “knowingly caused” their daughter’s death, even though they used and sold drugs in another room for hours while their daughter’s condition deteriorated and they failed to notice her loud, pained cries.
He noted that the parents didn’t intentionally give fentanyl to the girl and didn’t let her “roam free overnight” while fentanyl was available. He also wrote that Casias screamed when she finally discovered the girl’s body around 2 p.m. on Jan. 2. Surveillance video shows Aviyana made her “last gargled cry” at 6:50 a.m. that morning, according to an affidavit.
