DA Gonzales will limit DWI plea bargains, says ‘too many’ got breaks who shouldn’t have

cases and will rule out leniency for defendants with previous drunken driving offenses or highly elevated blood-alcohol readings., said the paper’s reporting showed that “too many offenders” who injured people while driving drunk or whose blood alcohol tests indicated extreme intoxication had “benefited” from plea bargains that allowed them to avoid DWI convictions.

People with prior drunken driving convictions were not eligible. Nor was anyone who had caused an accident or whose blood alcohol concentration, or BAC, was.15 or above. An Express-News analysis of Bexar County court records from 2009 to 2022 found that 69,000 people were charged with DWI-related offenses during that period, and more than 19,000 of them - 28 percent - avoided DWI convictions by pleading to obstructing a highway.

Caltzontzi-Jimenez’s BAC was measured at 0.176. He pleaded guilty to intoxication assault and was sentenced to five years in prison.
