Deputy Michael Miscione told investigators he fell asleep at the wheel before his truck barreled into a disabled vehicle on the 5 Freeway in Mission Viejo.
Orange County prosecutors are considering criminal charges against a Los Angeles County sheriff’s deputy who was off-duty when he fell asleep at the wheel in November 2022 and killed two Camp Pendleton Marines sitting in a disabled car.

James Patton was killed in November 2022 in a traffic accident in Orange County. “Two Marines die through no fault of their own and there were crickets,” complained Patton’s father, Michael. Miscione had gotten off work at 3 a.m. and was driving his Chevrolet Colorado truck in the high-occupancy vehicle lane at about 88 mph — more than 30 mph above the construction zone speed limit — at the time of the crash, according to the report.
