OAKLAND — Just a year after he was allowed to serve the remainder of his 12-year prison term at home, Derick Almena, the master tenant of the Ghost Ship warehouse where 36 people died in a 2016 fire, may be on the verge of another stint in jail.
It is that last item, the bullet, that may land 52-year-old Almena in legal hot water. Prosecutors have filed paperwork alleging that by possessing it he committed a felony by violating the portion of California’s penal code forbidding felons from possessing any ammunition. In January 2021, Almena pleaded no contest to 36 counts of involuntary manslaughter, one for each person killed in the fire.
Almena’s three-year probation term includes being subject to warrantless searches. The Mendocino County probation department decided to go to his home after he moved to Ukiah from Lake County, according to court records. The fire at the warehouse in East Oakland’s Fruitvale District killed 36 people, most of whom were there for a dance party. One victim was a resident of the warehouse. After the fire, investigators found numerous fire hazards, including a wooden staircase leading up to the dance floor, no fire exit signs, RVs parked on the first floor and numerous pianos, organs and other flammable material packed inside the maze-like, 10,000-square-foot property.
