A Senate review of the 21-year-old RP-US Visiting Forces Agreement (VFA) will be a waste of time should the President directs the termination of the agreement, Senate Minority Leader Franklin M. Drilon said Monday.
Plans are afoot for a Senate review of the VFA even if the Philippines unilaterally abrogates the treaty.
“To me, the termination of the VFA is a death sentence to long-standing Philippines and United States defense alliance,’’ Drilon, a former Justice secretary during the Cory Aquino presidency, said. Earlier, Senate President Vicente C. Sotto III and Senators Drilon and Panfilo M. Lacson filed a resolution expressing the sense of the Senate that President Duterte should reconsider his plan to unilaterally abrogate the VFA.“EDCA is an Executive Agreement. The legality of EDCA is drawn principally from the VFA. The Supreme Court in 2016 upheld the legality of EDCA because the US and the Philippines have an existing treaty that is already concurred into by the Senate, which was the VFA.
The presence of US personnel, vessels and aircraft in the Philippines is allowed by virtue of the VFA.
