They were among seven people hurt when a limb broke off a tree and fell onto them on the walkway below. All were hospitalized.
All of the family was hurt March 15 while visiting the zoo on Spring Break, but daughter Jordyn’s injuries were particularly severe, according to the lawsuit. She suffered a traumatic brain injury, was in a coma for several days and required surgery.
The family is suing for past and future medical expenses, pain and suffering, mental anguish, loss of earnings, punitive damages and other damages.“The tree branch that broke off and struck the Rodriguez family has been estimated to weigh between 1500 and 2000 pounds,” the suit says. It adds that a sign stated the tree was being “preserved” — an indication that the Zoological Society was aware of its condition.
As part of the suit, the Rodriguez family seeks a temporary restraining order to prevent the defendants from taking any action that might alter, damage or destroy any evidence — “including, but not limited to,” The emphasis on remnants is included in the lawsuit. Alamo City Arbor Care’s crew cleaned up all the debris and threw it in the company’s wood chippers, Chalker said. But he added he has saved a “broken piece of wood” that he said was about 21 inches in length.
