“The problem is that there’s already a number of laws on the books that, in theory, could be used to prevent actual interference with law enforcement,” ACLU legal director Jared Keenan tells the. “The law didn’t criminalize interfering with the law officer. It only criminalized activity of recording a law enforcement officer within 8 feet.”

“I was assuming that the attorney general would do his job as the state’s attorney and defend a law passed by the state,” Kavanagh tells AP. “We are trying to get together with the speaker and the president and see if the Legislature will defend it, but there’s also the possibility of some outside group possibly stepping up. Kavanagh notes that his original bill had already been changed several times in response to the ACLU’s concerns, including reducing the distance from 16 feet to 8 feet, limiting the scope of police activities it applies to and exempting certain people from the ban .
