A Marion County judge issued a preliminary injunction Friday against Indiana's near-total abortion ban, this time as part of a lawsuit that claims the ban violates religious freedom protections.
The five women who are opposing the new abortion law in the lawsuit practice Judaism, Islam, Unitarian Universalism, Episcopalianism or paganism. They are seeking class action status and are joined as plaintiffs by the group Hoosier Jews for Choice.The defendants in the case include members of the Medical Licensing Board of Indiana and prosecutors in five counties where abortion services are offered, including Marion, Monroe and St. Joseph counties.
Attorneys for the state had argued the women behind the lawsuit failed to demonstrate the abortion ban substantially burdens their exercise of religion and the lawsuit is premature because the women aren't currently seeking abortions.
