The doctors are claiming compensation for unrostered overtime as well as penalties against the hospitals for allegedly breaching the Fair Work Act by not paying for unrostered overtime.Doctor Gavin Wayne says he has experienced microsleeps when driving home after a long shift. "After a 16-hour day, I get to my car and I think, I really hope I'm going to be able to get home safely … I've been driving home and you realise you've been having microsleeps."

"We're worried about our futures and we're worried about being the nail that sticks out that gets hammered. Lawyer Andrew Grech says hospitals do not know the real cost of caring for pateints because many doctors' hours are not being logged. "Even at a very self-interested level, I certainly don't want to go to a hospital and be diagnosed by a doctor who's had less than a few hours' sleep and has worked continuously for three or four days."
