Melvin Robertson accused officer Robert Taylor of negligence and using excessive force when he shot Robertson in August 2021 in the store parking lot on West 117th Street.
CLEVELAND, Ohio — A man shot by a Cleveland police officer working off-duty at a Giant Eagle on Cleveland’s West Side sued the city and the grocery store chain.
Taylor was not disciplined for the shooting. At the time, police officials said Robertson pointed a gun at Taylor before the officer shot him. Robertson’s mother, Tonya, told cleveland.com and The Plain Dealer her sonRobertson was placed in a medically induced coma after the shooting. He still suffers from pain in his hip and nightmares. He fears that police will “use unjustified force against him” in the future, according to the lawsuit.
Taylor spoke with Robertson’s cousin, who told the officer that Robertson had a gun, the lawsuit said. Robertson stumbled as he ran, and a gun and cellphone fell out of his pants. He picked up the gun and kept running, according to the lawsuit. He never pointed the gun at Taylor, according to the lawsuit.“It was a wholly unnecessary interaction,” Gelsomino said. “The officer created the situation and then escalated it. Melvin was just trying to get away.”
