In 1938, Congress passed the Fair Labor Standards Act . As one of the hallmark pieces of legislation from Franklin D. Roosevelt’s New Deal, the FLSA established employment standards that we now take for granted, including the 40-hour work week and time-and-a-half overtime pay. Still, not all of the FLSA’s mandates apply to all workers. One major exception exists with overtime pay.

In 2016, the DOL tried raising it to $47,476, or $913 per week. And not only did this previously proposed rule call for a more significant raise, but it also included automatic adjustments that would take effect every three years; the current proposed rule does not have a provision for an automatic adjustment.
