OSHA: Dallas church illegally fired employee who reported unsanitary conditions
A Dallas church illegally fired an employee in 2021 after the employee reported unsanitary conditions, including insects and rodents in the church’s food-service areas and near children’s sleeping cots, according to a report issued Thursday by the U.S. Department of Labor.
“New Mount Zion Baptist Church’s actions toward the employee are unacceptable and deeply concerning,” OSHA Dallas regional administrator Eric S. Harbin said in a statement. “The existence of rodents and insects in food preparation and serving areas poses a health hazard. The employee had the legal right to express apprehensions about the unhygienic surroundings and should not have been fired for doing so.
The employee was hired by the church as a nutrition specialist on May 5, 2021, according to the OSHA report. About three weeks later, the employee began noticing spiders and insects in the childcare’s kitchen area. The employee reported concerns to a day care director. The church began writing up the employee on disciplinary infractions after he spoke up, OSHA reported. In one instance, the employee was disciplined for wearing shorts above the knee, which the employee disputed. OSHA noted the church did not have a dress code policy for employees. The employee was also disciplined for lying on a couch at the church.
