The Ministry says a policy mandating people on SAID to file for their Canadian pension Plan early is discriminatory.

“What motivated us recently is the Manitoba Court of Appeal decision that came down in May of 2022,” said Gilmer, who explained the Court found the province would have to change its policy around forcing people on income assistance to access CPP early.

Gilmer said the challenge comes now “given how long this policy and practice has been in place and the inspiration of the Manitoba ruling.” He said the time is right.The decision from Manitoba states the policy of mandating people on disabilities to access their CPP early “widens the gap between persons with disabilities who receive income assistance and the rest of society by perpetuating their dependence on income assistance.

“This court case just proves what we already know: the Sask. Party is completely out-of-touch with the folks struggling most,” said Conway.
