A Richardson man who stormed the U.S. Capitol during the Jan. 6, 2021, riot and threatened Democratic lawmaker Alexandria Ocasio-Cortez on social media was sentenced to more than three years in federal prison.to multiple charges, was sentenced Wednesday to 38 months behind bars followed by 36 months of supervised release, the U.S. attorney’s office for the District of Columbia said.
Clinton Broden, an attorney for Miller, noted that the sentence was less severe than what prosecutors had sought and said in a written statement that his client has “expressed his sincere remorse” for his conduct. “It should be always be remembered that … his actions and the actions of many others were a product of rhetoric from a cult leader that has yet to be brought to justice,” Broden said.Miller’s charges included three counts of interfering with law enforcement during a civil disorder, along single counts of assaulting a police officer, interstate threat to injure or kidnap, entering a restricted area and engaging in disorderly conduct in a capitol building.
According to a federal complaint, Miller shared videos on social media showing himself inside the Capitol during the riot. He was arrested in the weeks following the insurrection. In the days leading up to Jan. 6, Miller created Facebook posts saying he was going to attend a pro-Donald Trump rally in Washington, D.C., and that he would bring “a grappling hook and rope and a level 3 vest,” according to the complaint. Miller also wrote that he brought “a lot of guns” at a previous Trump rally at the nation’s capital.
