Ten was largely vindicated in Monday’s ruling, but Justice Michael Lee was critical of the network’s “grossly improper and unjustifiable” conduct.

Network Ten’s conduct before Lisa Wilkinson’s infamous 2022 Logies speech was “grossly improper and unjustifiable” and the veteran broadcaster was let down by her employer’s actions, the judge presiding over the Bruce Lehrmann defamation case has found., with its truth defence proving on the balance of probabilities that Lehrmann raped former Liberal staffer Brittany Higgins in Parliament House in 2019.

Lee was especially critical of Ten’s legal advice to Lisa Wilkinson before the 2022 Logies speech, in which she emphasised the truth of Higgins’ allegations, which led to a delay in Lehrmann’s ACT criminal trial.Lee said Ten’s conduct at various points was egregious, unjustifiable, and apt to cause disruption to the criminal justice system.

While accepting Lee’s judgment, one of Ten’s solicitors, Justin Quill, said outside court that there must be more confidence in juries and that the implication juries would be so influenced by a Logies speech doesn’t “pass muster”.He said he was confident the network would get costs back from Lehrmann and any appeal by Lehrmann would be dismissed.

While still considering the 324-page ruling, the spokesperson said it was clear Australia’s defamation laws remain highly restrictive.
