Ho “has been assigned to appear as Attorney-in-Charge in this case on behalf of all Defendants,” the notice read., of Dallas, is co-chair of the 1,800-lawyer firm’s nationwide appellate and constitutional law practice group. She has presented more than 90 oral arguments in state and federal courts, many in high-dollar business disputes.
In April 2021, Gov. Greg Abbott and the two state agencies had to obtain separate lawyers from Paxton’s office because of a “perceived conflict,” according to the new attorneys’ notice. The protective services department once operated child placing agencies in several regions, which the commission filed enforcement actions against, the notice said. However, the need for separate lawyers has ended because the department gave up its licenses, it said.
Paxton’s media affairs office did not immediately respond to an email inquiring how much the three Gibson Dunn lawyers will be paid. Marcia Robinson Lowry, who founded Children’s Rights and now heads A Better Childhood, said state leaders should be focusing on “the serious and continuing problems that continue to be identified by the monitors,” not legal strategy.
Last week, Assistant Attorney General Reynolds Brissenden, who represents the commission, said Jack’s two monitors’ combined request for payment of $1.7 million for their work in March was more than usual, raising concerns.
