Moreover, another provision would protect consumers against discrimination and retaliation for asserting their rights. Aggrieved Texans can file a complaint with the Texas Attorney General’s office, which could force offending firms to pay up to $7,500 in civil fines if a consumer is unable to get satisfaction from the company.
It remains to be seen whether the enforcement process and data collection and sale opt out provisions are robust enough to discourage bad actors. Texas and other states have passed data privacy, cybersecurity and breach notification laws that range from narrow protections for student and health care data and biometric identifiers to broader protections for the solicitation of personal data from minors.
Over time, these relatively new state laws will be amended as emerging technology creates new privacy threats and states learn what works and what doesn’t. But personal data is ours to control, and companies must respect that choice.
